1. Acceptance of Terms
By accessing and using Dead Man's Switch ("the Service"), you accept and agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.
2. Description of Service
Dead Man's Switch is a personal safety notification system that:
Monitors your regular check-ins on a schedule you define
Sends reminder notifications to you via email, SMS, and push notifications when check-ins are overdue
Sends notifications to your designated emergency contacts if you fail to check in within the grace period
Uses your own email/SMS service credentials to send notifications
Is available as a Progressive Web App (PWA) for installation on your devices
3. User Responsibilities
3.1 Account Security
You are responsible for:
Maintaining the confidentiality of your account credentials
All activities that occur under your account
Notifying us immediately of any unauthorized use
3.2 Accurate Information
You agree to:
Provide accurate emergency contact information
Inform your emergency contacts that their details will be stored and that they may receive notifications on your behalf
Keep your contact information up to date
Test your notification system regularly
Configure realistic check-in schedules and grace periods
3.3 Proper Use
You agree NOT to:
Use the Service for any illegal purpose
Harass or spam your emergency contacts
Attempt to access other users' data
Interfere with or disrupt the Service
Use the Service in a way that could harm or overload the system
4. Service Limitations
4.1 No Guarantee of Delivery
While we strive for reliable notification delivery, we cannot guarantee:
Notifications will always be delivered
Notifications will be delivered on time
Email/SMS services will always be available
Your SMTP or Twilio credentials will remain valid
4.2 Third-Party Services
The Service relies on third-party services including Heroku (hosting), Supabase (database), Cloudflare (DNS/SSL), Firebase Cloud Messaging (push notifications), your email provider (SMTP), and Twilio (SMS). We are not responsible for:
Failures or outages of these third-party services
Changes to third-party service pricing or availability
Security breaches at third-party services
4.3 Beta Period Limitations
During the beta testing period:
Service availability may be intermittent
Features may change without notice
Data may be reset (we will notify beta testers first)
No Service Level Agreement (SLA) is provided
5. Privacy & Data
Your use of the Service is also governed by our Privacy Policy. Key points:
We store your account information, contacts, and check-in history
We encrypt sensitive credentials (SMTP passwords, Twilio tokens)
We never share your data with third parties for marketing, analytics, or any other purpose
You can delete your account at any time; a data export is provided automatically
6. User-Provided Credentials
6.1 SMTP Credentials
You provide your own email (SMTP) credentials to send notifications. You acknowledge that:
We store these credentials encrypted in our database
We only use them to send notifications on your behalf
You are responsible for any costs from your email provider
You should use app-specific passwords where possible (Gmail, Yahoo)
6.2 SMS Credentials (Optional)
If you choose to enable SMS notifications via Twilio:
You provide your own Twilio account credentials
You are responsible for Twilio costs (~$0.01 per SMS)
We only use your Twilio account to send notifications on your behalf
6.3 Push Notifications (Optional)
If you choose to enable push notifications:
Your browser generates a subscription with encryption keys, which we store to deliver notifications
Notifications are delivered via Firebase Cloud Messaging (Google)
Each device subscribes independently and can be disabled at any time
Push notifications work even when the browser tab is closed
7. Intellectual Property
The Service and its original content, features, and functionality are owned by Dead Man's Switch and are protected by international copyright, trademark, and other intellectual property laws.
8. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.
We do not warrant that:
The Service will be uninterrupted or error-free
Defects will be corrected
The Service is free of viruses or harmful components
Notifications will always be delivered successfully
9. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, DEAD MAN'S SWITCH SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES.
This includes but is not limited to:
Failure to deliver notifications
Late delivery of notifications
False alarms or missed check-ins
Loss of data
Service downtime
10. Emergency Services
IMPORTANT: Dead Man's Switch is NOT a substitute for emergency services.
This Service does not contact emergency services (911, police, ambulance)
In a real emergency, contact emergency services directly
Do not rely solely on this Service for life-threatening situations
11. Account Termination
11.1 By You
You may delete your account at any time from the Admin Panel (Account tab). This will:
Permanently delete your account and all associated data
Stop all monitoring and notifications
Send you a confirmation email with a JSON export of your data
Account deletion is immediate and cannot be undone.
11.2 By Us
We reserve the right to suspend or terminate your account if you:
Violate these Terms of Service
Use the Service for illegal purposes
Abuse or harass other users or contacts
Attempt to compromise the security of the Service
If we terminate your account, you will be notified via email and provided with a copy of your data where possible.
12. Changes to Terms
We reserve the right to modify these Terms at any time. Changes will be posted on this page with an updated "Last Updated" date. If we make significant changes, we will notify you via email and a prominent notice on the dashboard. Your continued use of the Service after changes are posted constitutes acceptance of the modified Terms.
13. Beta Testing Specifics
During the beta period, access to the Service is by invitation only. Accounts are created via invitation links issued by the platform administrator.
As a beta tester, you agree to:
Provide feedback about bugs, issues, and feature requests
Not rely on the Service as your sole safety system during beta
Accept that features may change based on testing feedback
Understand that service may be interrupted for updates/fixes
14. Governing Law
These Terms shall be governed by and construed in accordance with the laws of Canada, without regard to its conflict of law provisions.
